Terms of Service

These Terms of Service ("Terms") govern your use of Link Directory (the "Directory"), including browsing the Directory, submitting a website for listing (a "Submission") and paying for any paid listing service. The Directory is operated by its owner, based in Malaysia ("we", "us", "our"). By submitting a website, ticking the agreement box on the submission form or making a payment, you ("you", the "Submitter") confirm that you have read, understood and agree to be bound by these Terms and by our Acceptable Use Policy, which forms part of these Terms. If you do not agree, do not use the submission service.
You must be at least 18 years old, or the age of majority where you live, to make a Submission or a payment. If you submit on behalf of a business or other organization, you represent that you are authorized to bind it to these Terms, and "you" includes that organization. You must be the owner of the submitted website or be authorized by its owner to submit it.
The Directory is a human-edited web directory. Every Submission is reviewed at our sole discretion. We may accept, reject, edit (including the title, description and category), move, suspend or remove any Submission or listing at any time, with or without notice and without giving reasons. Submission, and payment, do not guarantee acceptance, a particular category, placement, ranking, traffic, search-engine indexing, link attributes (such as "follow", "nofollow" or "sponsored") or any commercial result. Review times are estimates only.
You remain the owner of the content you submit, including your website's name, description and URL ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, edit, adapt, publish and display Your Content in connection with operating and promoting the Directory, for as long as it is listed and for a reasonable period afterwards for archival and backup purposes.
You represent and warrant that: (a) all information you provide is true, accurate and complete; (b) the submitted website and Your Content comply with all applicable laws and with our Acceptable Use Policy; (c) Your Content does not infringe any intellectual property, privacy or other rights of any third party; and (d) you will keep your contact e-mail address valid while your listing is active.
Some listing types are offered for a fee ("Fees"), as shown on the submission form at the time of your Submission. Fees are payable in advance, in the currency displayed, through PayPal or any other payment processor we make available. Your payment is also subject to the processor's own terms and policies. A paid listing is activated only after the payment has been received in full and the Submission has been accepted. We may change our Fees at any time; changes do not affect a payment already made.
ALL SUBMISSIONS AND ALL PAYMENTS ARE FINAL. Fees are consideration for the review of your Submission and for making the listing service available, and are earned in full when paid. To the fullest extent permitted by applicable law, Fees are non-refundable in whole or in part, and no refund, credit or pro-rata adjustment will be given for any reason, including without limitation where: (a) your Submission is rejected, edited, re-categorized or placed differently from your request; (b) your listing is suspended or removed for breach of these Terms or the Acceptable Use Policy; (c) you cancel a subscription before the end of the current billing period; (d) the submitted website becomes unavailable, changes ownership or changes content; (e) you are dissatisfied with the traffic, ranking or any other result; or (f) the Directory is modified, interrupted or discontinued. Nothing in this section excludes any right to a refund that cannot be excluded or limited under the consumer protection laws that apply to you.
Where a listing is sold as a recurring subscription, you authorize PayPal to charge the displayed Fee at the start of each billing period until you cancel. You may cancel at any time in your PayPal account. Cancellation stops future payments only; your listing remains active until the end of the period already paid for, after which it may be removed or marked as expired. Payments already made are not refundable under section 7.
You agree not to initiate a chargeback, payment reversal or PayPal dispute for Fees paid in accordance with these Terms, and to contact us first through our contact page about any billing question. If a payment is reversed, charged back or disputed, we may immediately suspend or remove every listing connected with you, refuse future Submissions from you, and recover the amount reversed together with any fees charged to us.
We may suspend or terminate your listing, and your access to the submission service, at any time and for any reason, including a breach of these Terms or the Acceptable Use Policy, a request from a competent authority, or a decision to change or close the Directory. Sections 4, 5, 7, 9 and 11 to 16 survive any termination.
The Directory lists and links to websites operated by third parties. We do not control, endorse or accept responsibility for any third-party website, its content, products, services or privacy practices. Your dealings with any listed website are solely between you and its operator.
Listings are submitted by users, website owners and other third parties. We do not create, verify or guarantee the accuracy, legality or ownership of any submitted website, title, description or other content, and we have no obligation to monitor listings. Each Submitter is solely responsible for the listings they submit. A listing, and any link from the Directory to a website, does not mean that we endorse, sponsor or are affiliated with that website or its operator. To the fullest extent permitted by law, we are not liable for any loss or damage of any kind, including any loss of search-engine rankings, traffic, revenue or reputation, arising from any listing, from any link to or from the Directory, or from the acts or omissions of any Submitter or third party.
Requests to remove or change a listing must be sent through our contact page and must: (a) identify the exact listing, by its address in the Directory; (b) come from the owner of the listed website, or from the holder of the rights concerned, or their authorized representative; and (c) where we ask, be confirmed from an e-mail address on the listed website's domain or by another means that reasonably shows ownership or authority. We review requests in good faith and decide at our sole discretion whether, how and when to act on them. We are not obliged to act on requests that are anonymous, incomplete, unverifiable, threatening, abusive or sent in bulk, and we never charge for removing a listing - nor do we accept any demand for payment in connection with a removal. We accept no liability for any delay in handling, or for declining, a removal request. Nothing in this section limits any right or obligation that applicable law provides regarding unlawful content.
THE DIRECTORY AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, TRAFFIC, RANKINGS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE DIRECTORY OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities and expenses, including reasonable legal fees, arising out of Your Content, your website, your breach of these Terms or the Acceptable Use Policy, or your violation of any law or third-party right.
We may update these Terms from time to time by publishing a new version on this page with a new effective date. The version in force at the time of your Submission or payment applies to that Submission or payment; continued use of the Directory after a change means you accept the updated Terms.
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. You agree that the courts of Malaysia have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Directory, without depriving you of any mandatory protection of the laws of your country of residence. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. These Terms, together with the Acceptable Use Policy, are the entire agreement between you and us about the Directory.
